January
1, 2009 marks the roll-out of the law banning text-based
communication while driving in California, complementing
the requirement of using hands-free
devices to talk on cell phones (SB 1613) that went
into effect about 6 months ago.
Penalties
are similar to the formerly-enacted laws, resulting
in a $20 fine for the first offense and $50 fines for
second and subsequent offenses. Additional penalty assessments
could triple the base fines.
This
law appears to be broader in scope than simply texting
on cell phones, with the distinction of any devices
used to communicate in a text-based fashion including,
but not being limted to, texting, email and instant
messaging. It applies to reading, writing or sending
text-based communications for all drivers - formerly
targeted only to drivers under 18.
